1. Introduction
This Privacy Policy (the "Policy") sets out how One Point Five, inc. (the "Operator", "we" or "us"), the operator of the iOS application "Dameter" (the "App"), handles information obtained through use of the App. We are the business responsible for the handling of information obtained under this Policy (the "controller" within the meaning of the EU General Data Protection Regulation (GDPR)).
The App is an entertainment application built around self-deprecating humor. It is not intended for medical purposes, health guidance or fitness instruction.
We handle users' information in accordance with this Policy. Please read this Policy before using the App.
2. Information We Collect
In providing the App, we obtain the following information.
2.1 Information obtained from HealthKit
Based on the user's consent, the App obtains the following information from HealthKit provided by Apple.
- Step count
- Distance traveled
- Active energy (calories burned)
This information is used to calculate the score within the App (the "Slacker Score"). Users may revoke the App's access permission at any time in the iOS Settings app.
Information obtained from HealthKit is processed only on the user's device and is not transmitted to our servers or to iCloud. We do not use this information for advertising, marketing or any purpose other than providing the functions of the App, and we do not disclose it to third parties.
2.2 Information obtained from Screen Time (DeviceActivity)
Based on the user's consent, the App obtains the following information from the Family Controls framework (DeviceActivity) provided by Apple.
- Total daily screen time (in seconds)
The App requests only the .individual authorization of Family Controls and does not provide any functionality for monitoring others or restricting apps or websites. We do not obtain per-app usage time (by app name or Bundle ID), category-level usage breakdowns, web browsing history, notification counts or pickup counts.
As with the HealthKit information described above, information obtained from Screen Time is processed only on the user's device, is not used for advertising or any other purpose, and is not disclosed to third parties.
2.3 Usage of the App itself
In order to calculate "Namataro Level", one of the metrics that make up the Slacker Score, the App records the following usage of the App itself on the user's device.
- Time spent with the App open
- Time spent playing content within the App
- Number of mini-game sessions played within the App
This information concerns the use of this App only. It does not capture the user's use of other apps, web browsing history or any other activity outside the App.
2.4 Account information
The App creates anonymous accounts using Firebase Authentication provided by Google LLC. The App does not use external authentication such as Sign in with Apple, and does not obtain your name or email address. The name shown in the ranking feature is a nickname that you set yourself within the App.
2.5 Score and usage data
The App stores the following information on servers using Cloud Firestore provided by Google LLC.
- The Slacker Score and aggregate values derived from it, such as averages, totals and the number of days recorded (the underlying values such as step counts are not transmitted)
- Settings information relating to use of the App
- Other information necessary to provide the functions of the App
2.6 Nicknames
The App obtains the nickname set by the user and displays it to other users through features such as the App's ranking function.
Nicknames may be set and changed at the user's discretion and should not include a real name or other personal information that directly identifies the individual. Users set their nicknames at their own responsibility.
2.7 Information relating to reports and blocking
The App provides a function for reporting to us user-generated content that violates the Terms of Service, and a blocking function for excluding other users' user-generated content from one's own display. In connection with the use of these functions, we obtain the following information.
- The identifier of the user who submitted the report
- The identifier and nickname of the reported user, or the identifier and group name of the reported group
- The reason (category) for the report and any supplementary information (optional free text)
- The date and time of the report
- The identifier of the user who performed the block and the identifier of the blocked user
We use this information for the purposes of content moderation within the App, investigating and responding to violations of the Terms of Service, and ensuring the safety of the Service.
2.8 Information relating to purchases and subscriptions
In order to manage the status of in-app purchases (the consumable item "Dara P", auto-renewable subscriptions and the like), the App obtains and stores the following information.
- Purchase and subscription enrollment and active status (transaction information is managed by Apple Inc., and we refer to its status)
- The balance of "Dara P", purchase history and the status of owned items
- The status indicating that the user has previously enrolled in a subscription
This information is stored on the user's device and, for restoration when changing devices or reinstalling, in iCloud provided by Apple (NSUbiquitousKeyValueStore). Information concerning credit card numbers or other payment methods is managed by Apple, and we do not obtain it. Note that, in order to understand usage patterns, the App may obtain an anonymous label indicating the status of purchase and subscription operations (such as the enrollment or cancellation category) as usage data under Section 2.10; however, we do not transmit purchase amounts or any other information that identifies an individual.
2.9 Crash logs
Using Firebase Crashlytics provided by Google LLC, the App obtains log information necessary to analyze abnormal terminations of the App (device model, OS version, stack trace and the like) when they occur.
2.10 Usage data
Using Firebase Analytics provided by Google LLC, the App obtains anonymous statistical information relating to use of the App (screen transitions, frequency of feature use, language settings and the like).
2.11 Information stored on the device
The App stores the user's settings and part of the history information within the user's device (the SwiftData database and the App Group shared container). This information is processed only within that device.
Only when the user starts the App's "recording mode", the front camera feed is used on the device solely to create a video. The resulting video is added to the photo library only when the user chooses to save it (add-only access; existing photos and videos are never read) and is not transmitted to our servers.
2.12 Information when visiting the official website
We operate the official website of the App using Firebase Hosting provided by Google LLC. When a user browses that website, the IP address, browser type (User-Agent), referrer and similar items are recorded as standard access logs of Firebase Hosting. These are used for the operation of Firebase Hosting, detection of unauthorized access and statistical understanding of usage.
This website may store the user's theme setting (light/dark toggle), the state of effects already displayed and similar items in the user's browser localStorage. These are processed only within that browser and are not transmitted to our servers.
This website (the official website, excluding the App itself) does not use third-party tracking services, analytics services or advertising services. For in-app advertising, please refer to 2.14 above. Nor does it load fonts or scripts from external CDNs.
2.13 Information relating to group rankings
The App provides a function whereby users may create or join a group using a passphrase and share scores within that group (group rankings). In connection with the use of this function, we store the following information on servers using the aforementioned Cloud Firestore.
- The group name
- Membership information for that group (a list of identifiers of participating users)
- Each participant's nickname shared within the group, score for the most recent finalized date, weekly average score and favorite title
Of this information, each participant's nickname, score for the most recent finalized date, weekly average score and favorite title are displayed to other users participating in the same group. Users may stop sharing this information by leaving the group or by opting out of the ranking function.
2.14 Information relating to in-app advertising
Using "Google AdMob", an advertising service provided by Google LLC, the App may display banner advertisements at the bottom of the main screen and rewarded advertisements within the mini-games (advertisements which the user chooses to watch voluntarily). The functions available free of charge can be used without watching rewarded advertisements.
In connection with the delivery of advertisements, Google AdMob may obtain the advertising identifier (IDFA), device information and information relating to the display of and interaction with advertisements. For details of the information obtained and how it is handled, please refer to Google's Privacy Policy (https://policies.google.com/privacy) and "How Google uses information from sites or apps that use our services" (https://policies.google.com/technologies/partner-sites).
Where the App carries out tracking using the advertising identifier, it will first request permission via iOS App Tracking Transparency. If permission is not granted, non-personalized advertisements are displayed. In addition, no in-app advertisements are displayed while the user is subscribed to the "Namataro Support Subscription".
For users in regions where consent for advertising is required by law (such as the European Economic Area, the United Kingdom and Switzerland), the App displays a consent management form provided by Google (User Messaging Platform) before displaying advertisements. Users may change or withdraw their choice at any time from the Settings screen of the App.
2.15 Device information and IP address
When the App communicates with the services of Google LLC described in Sections 2.4, 2.9, 2.10, 2.14 and 2.16, those services obtain, to the extent necessary to provide them, the device model, OS version, App version, language setting, IP address and an app-specific identifier generated for each installation. These are used to establish communication, detect misuse, analyze defects and compile statistics, and we do not use them to identify individual users.
2.16 Verification information for preventing misuse
The App uses Firebase App Check provided by Google LLC to verify that access to our servers originates from a genuine copy of the App. For this verification, device attestation information generated by App Attest or DeviceCheck provided by Apple is transmitted to Google. This information is used only to confirm the legitimacy of the device and does not identify individual users.
3. Purposes of Use and Legal Bases
We use the information obtained under the preceding article for the following purposes.
- To provide the functions of the App (calculation of the Slacker Score, display of history, generation of diary entries and notifications and the like)
- To manage and authenticate users' accounts
- To analyze defects in the App, improve quality and develop new features
- To statistically understand and analyze usage of the App
- To provide notice of revisions to this Policy, the Terms of Service and other rules
- To respond to inquiries from users
- To moderate user-generated content, investigate and respond to violations of the Terms of Service, and ensure the safety of the Service
3.1 Legal bases
For users to whom the GDPR or similar laws apply, we process information on the following legal bases.
- Performance of a contract: calculating the Slacker Score, providing the ranking and group functions, managing purchase status and providing the other functions of the App that users request
- Legitimate interests: analyzing defects, improving quality, understanding usage statistically, preventing misuse, moderating user-generated content and ensuring the safety of the Service
- Consent: obtaining information from HealthKit and Screen Time, using the advertising identifier via App Tracking Transparency, and displaying personalized advertisements through the consent management form
- Compliance with legal obligations: responding to disclosure requests under applicable law and fulfilling our other legal obligations
Where processing is based on consent, users may withdraw their consent at any time. The means of withdrawal are set out in Article 7.
4. Provision to Third Parties
We will not provide, sell or share users' information with third parties except with the consent of the individual or as required by law. However, the transmission of information to the services provided by Google LLC set out in Article 2 (Firebase Authentication, Cloud Firestore, Firebase Crashlytics, Firebase Analytics, Firebase App Check and Google AdMob) is carried out in order to provide the functions of the App and does not constitute provision to a third party under this Article.
The handling of information in those services shall be governed by the privacy policy established by Google LLC.
5. International Transfer of Information
Information that the App stores on servers (Sections 2.5, 2.7 and 2.13) is stored on servers operated by Google LLC located in Japan (the asia-northeast1 region). Information obtained through Firebase Authentication, Firebase Crashlytics, Firebase Analytics, Firebase App Check and Google AdMob, however, may be processed on servers operated by Google LLC and its affiliates in the United States or other countries.
The level of personal data protection in the destination country may differ from that in the country or region where the user resides. Google LLC undertakes to carry out such transfers in accordance with the EU Standard Contractual Clauses or other transfer mechanisms recognized under applicable law, and we entrust the handling of this information to Google LLC under the data processing terms concluded with Google LLC. For details, please refer to Google's Privacy Policy and the Google Cloud data processing terms.
6. Retention and Deletion of Data
- Users may delete information stored on their device by uninstalling the App.
- Users may revoke HealthKit and Family Controls authorization at any time from the iOS Settings app. If authorization is revoked, acquisition of the relevant information will stop, but use of the App may continue (metrics that can no longer be obtained are treated as "no data" and the score is calculated from the remaining metrics).
- Users may use the "Delete account" function provided on the Settings screen of the App to delete their account (the identifier of the anonymous account), the score history and Free Dara P stored on the device, and the information stored on servers through the ranking function and similar features (nickname, scores, group membership information and the like). Paid Dara P, dress-up items and subscription entitlements are not subject to deletion and are retained under the same Apple Account.
- A user who is unable to use the account deletion function, or who otherwise wishes to have information stored on our servers deleted, may request such deletion by contacting the inquiry desk set out in Article 10. We will respond to such request within a reasonable period after verifying the identity of the individual.
- In principle, we retain information stored on servers for the following periods. Information beyond those periods will be deleted or anonymized by reasonable means.
- Information stored on servers through the ranking and group functions (Sections 2.5 and 2.13): until the user deletes their account. If the user opts out of the ranking function, this information is no longer displayed to other users but is retained until account deletion in case the user opts in again.
- Information relating to reports and blocking (Section 2.7): for the period necessary for moderation, responding to violations of the Terms of Service and preventing recurrence
- Crash logs (Section 2.9): 90 days from collection
- Usage data (Section 2.10): 14 months from collection
7. Your Rights
In accordance with applicable law, users may exercise the following rights with respect to their information held by us.
- The right to request disclosure of their information (including notification of the purposes of use)
- The right to request correction, addition or deletion of their information
- The right to request suspension of use or erasure of their information, and suspension of provision to third parties
- The right to withdraw consent where processing is based on consent
- The right to object to processing based on legitimate interests
- The right to receive the information they have provided in a commonly used, machine-readable format (data portability)
- For users residing in the European Economic Area or the United Kingdom, the right to lodge a complaint with the supervisory authority in their place of residence
Consent may be withdrawn by revoking the HealthKit, Family Controls and tracking permissions in the iOS Settings app, or by changing the advertising consent settings on the Settings screen of the App. To exercise any other right, please contact the inquiry desk set out in Article 10. We will respond within the period prescribed by law or, where no period is prescribed, within a reasonable period, after verifying the identity of the individual. Where we are unable to verify the identity of the individual, where we are not obliged by law to comply with the request, or where there is otherwise a legitimate reason, we may decline all or part of the request after notifying the user of the reason. We do not charge a fee for the exercise of these rights.
Because the App uses anonymous accounts and we do not hold users' names or email addresses, we may ask you to provide the nickname set in the ranking function, the names of groups you have joined, whether you have a purchase history, or other information designated by us in order to verify your identity when exercising your rights.
8. Children's Privacy
The App is not primarily intended for children under the age of 13, or under the age at which, under the laws of their country or region of residence, they may consent to the handling of their information without the consent of a guardian (up to 16 in the European Economic Area). Where such a child uses the App, such use shall be under the supervision of a guardian. If we become aware that we have obtained information from such a child without the consent of a guardian, we will promptly delete such information.
9. Changes to This Policy
We may change this Policy due to changes in laws and regulations, additions to the functions of the App or other circumstances. Where we change this Policy, we will post the revised Policy in the App or on a website designated by us, and the revised Policy shall take effect from the time of such posting. Where a change materially affects users, such as the addition of categories of information collected or a change in the purposes of use, we will notify users by means of a notice within the App before the change takes effect. The date of the last update to this Policy is shown at the top of this page.
